Where Fossils Are Found — and the Law
Picture a road cut on a long highway drive — those raw, layered walls where the bulldozers sliced straight through a hillside. Slow down and look closely, and you might be staring at a hundred million years of seafloor stacked like the pages of a book. That is where fossils live: not scattered randomly across the planet, but tucked into very particular rocks, in very particular places. Once you know what to look for, the landscape starts telling you where to point your eyes — and once you know the rules, you can enjoy all of it without ever putting a fossil, or yourself, at risk.
The Right Rock: Sedimentary
Here is the single most useful fact in all of fossil hunting: fossils are found almost exclusively in sedimentary rock. That is the rock that forms when mud, sand, lime, and silt settle in layers and slowly harden — limestone, shale, and sandstone are the big three. When a plant or animal is buried quickly by sediment, especially in or near water, it has a chance to be preserved as the mud turns to stone around it.
The other two rock families almost never hold fossils. Igneous rock cools from molten magma — nothing living survives that. Metamorphic rock has been cooked and crushed by heat and pressure, which destroys any fossil that was there. So when you read a landscape, you are really reading for sediment.

- Shale — fine mud rock that can preserve delicate detail, like leaves
- Sandstone — coarser, and a classic home for tracks and bones
Where the Rock Shows Itself
Fossils sit inside that sedimentary rock, but you cannot see through hillsides. What you are really hunting for is exposure — places where erosion or digging has peeled back the soil and laid the layers bare.
The reliable spots are the dramatic ones: road cuts sliced by highway crews, badlands stripped down to bare rock by wind and rain, cliffs and sea bluffs, stream banks where flowing water keeps cutting fresh faces, and quarries where stone is dug for building. All of these do the same favor — they bring buried layers up into the daylight where you can reach them. Fresh exposures matter, because every storm that erodes a badland slope can reveal something hidden the week before.
Then Comes the Law
Finding a fossil and being allowed to keep it are two different things, and in the United States it depends almost entirely on who owns the ground you are standing on. This part is not scary — just worth getting right, because the rules genuinely change from one fence line to the next.
The keystone is the Paleontological Resources Preservation Act of 2009 (PRPA), the first federal law written specifically to protect fossils on public land. It directs agencies like the Bureau of Land Management, the Forest Service, and the National Park Service to manage fossils using sound science — and it sets clear lines about what the public may and may not collect.
- Vertebrate fossils — dinosaurs, mammals, fish, reptiles, and their bones, teeth, and tracks — are protected. Collecting them generally requires a research permit.
- Common invertebrate and plant fossils — shells, trilobites, leaves — may often be collected in reasonable amounts for personal, non-commercial use on some federal lands.
- National Parks are off-limits: collecting fossils there is prohibited.
- State and private land each have their own rules, and private land always requires the owner's permission.
How the Federal Agencies Differ
On BLM land, anyone may collect a reasonable amount of common invertebrate and plant fossils, plus petrified wood, for personal use without a permit — the BLM sets that "reasonable amount" at up to 25 pounds of common non-vertebrate fossils per day. The catch: these fossils are for you, not for sale or trade.
On National Forests and Grasslands, the Forest Service allows similar casual collecting of common invertebrate and plant fossils — up to 25 pounds per day and 100 pounds per year — using only small hand tools, with no real digging. Vertebrate fossils still need a permit, and nothing collected may be sold.
In the National Parks, the answer is simply no. Under longstanding regulations, collecting fossils for recreational or educational use is prohibited in every park unit. If you spot something remarkable on protected land, the right move is the same everywhere: leave it exactly where it is, take a photo, note the location, and tell a ranger or a local agency office. Many important discoveries start exactly that way.
A few honest reminders: rules vary by agency, by state, and even by area or season. Never dig at protected sites, and never broadcast the precise location of a significant find — quiet localities stay safe localities. When in doubt, leave it in place and ask first.
